What Florida law requires

Florida Statutes section 718.112(2)(g) requires a residential condominium association to have a structural integrity reserve study completed at least every 10 years for each building that is three habitable stories or higher. At a minimum the study covers the roof; the structure, including load-bearing walls and primary structural members and systems; fireproofing and fire protection; plumbing; electrical systems; waterproofing and exterior painting; windows and exterior doors; and any other item whose deferred maintenance or replacement cost exceeds $25,000 (or the higher inflation-adjusted amount set by the Division of Florida Condominiums) and whose failure to be maintained or replaced would negatively affect those items. It is based on a visual inspection and must be performed or verified by a Florida-licensed engineer or architect, or by a reserve specialist or professional reserve analyst certified by the Community Associations Institute or the Association of Professional Reserve Analysts.

Unit-owner-controlled associations that existed on or before July 1, 2022 had to complete the study by December 31, 2025. An association whose milestone inspection under section 553.899 is due on or before December 31, 2026 may complete the two together, but in no event may the study be completed after December 31, 2026. A milestone inspection performed within the past 5 years that meets the paragraph's requirements may be used in place of the study's visual inspection. After completing a milestone inspection, an association may delay a required study for no more than the 2 consecutive budget years that follow it. Buildings under three stories are not covered, and neither are one- to four-family dwellings of three or fewer habitable stories, parts of a building outside the condominium, or parts maintained by someone other than the association.
