Where a condition survey sits in Florida law

A condition survey is not the milestone inspection required by Florida Statutes section 553.899. That section requires a condominium or cooperative building of three habitable stories or more to have a milestone inspection by December 31 of the year the building reaches 30 years of age, or 25 years where the local enforcement agency requires it (for example near salt water), and every 10 years after that. Phase one is a visual examination by a Florida-licensed architect or engineer; phase two, a more detailed inspection, is required only if phase one finds signs of substantial structural deterioration. If a proposal is meant to satisfy that requirement, the written scope should say so.
